Return and Cancellation Policy
All Labor, Delivery, Shipping, Handling, Parts and Installation Services and Fees are non-refundable. Once an order has been initiated, it can not be cancelled.
Defective service parts will be handled in accordance with the manufacturer's warranty.
Boot Networks, LLC will diagnose computer problems for a Service Fee. The amount of the Service Fee is indicated on the intial work order.
After diagnosis, an hourly fee will be charged for the work performed. The signed work order is your authorization for Boot Networks, LLC to
perform repairs on your computer.
All service cancellations must be made in writing to . Fees are due for services rendered until this written notification is received.
All billing errors must be reported within 30 days of receipt of your billing invoice. After 30 days all charges are final.
There is a $25 late fee for payment received 14 days or more past due. There is a $50 late fee for payments received 28 or more days past due.
Credit Card Authorization
By signing the initial work order you authorize Boot Networks, LLC to initiate a credit card transaction to debit your account for the amount of the transaction according to your verbal or written agreement with Boot Networks, LLC.
There is a $75 fee for chargebacks filed disputing any payment that you made for services provided to you by Boot Networks, LLC. You, the customer authorize Boot Networks, LLC to charge the chargeback fee of $75 to your credit card. If this charge is rejected, Boot Networks, LLC will pursue legal action to recoup losses for our time associated with responding to the chargeback in addition to any other fees. You agree to reimburse us or any representative we may appoint for any legal expenses your actions may make us incur.
There is a $50 fee for all returned checks regardless of circumstances.
Computer Repair Policies
Customer is hereby notified that their property is not not insured or protected to the amount fo the actual cash value thereof, or otherwise, against loss occassioned by theft, fire, or vandalism while the property remains with Boot Networks, LLC.
Boot Networks, LLC is not responsible for the unavailibility of parts or delays in parts shipments beyond it's control.
All charges for repairs including labor and materials furnished are due and payable simultaneously with the delivery of the property repaired by Boot Networks, LLC.
If the property presented for repair is not called for within five (5) days after notice is given, a storage charge of $15/day will be made for each day thereafter. The customer authorizes Boot Networks, LLC to apply this charge to the credit card number they provided.
In addition to any and all other legal remedies available, the customer authorizes Boot Networks, LLC to have a lien on the computer property delivered to Boot Networks, LLC for all charges for repair, including labor and parts, storage, late fees, as well as all fees and charges to enforce such lien. Boot Networks, LLC is hereby expressly authorized to sell said computer property after giving twenty (20) day written notice by certified mail to the customer of intent to do so. Proceeds from the sale of the computer property will first be used to satisfy the lien plus storage costs and costs incident to the sale. Said expenses for sale shall also include a reasonable attorney's fee, which may be necessarily incurred.
The customer hereby authorizes Boot Networks, LLC to hold the computer property delivered for repair as collateral for all fees and charges owed by the customer until they are paid in full.
If any such charges remain unpaid for thirty (30) days afer request for payment, Boot Networks, LLC may also refer such charges to its attorney for collection and the customer will pay a reasonable attorney's fee.
As an Internet service provider ("ISP"), Boot Networks offers its subscribers the means to acquire and disseminate a wealth of public, private, commercial and noncommercial information. Boot Networks also wants its subscribers to be fully informed of their rights and obligations -- and those of Boot Networks -- in connection with their use of the Internet. This Network Access Policy, which supplements and explains certain terms of each customer's respective services agreement (the "Services Agreement"), is intended as a plain English guide to those rights and obligations.
The fundamental fact about the Internet is that no one --neither Boot Networks, nor anyone else -- owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Boot Networks cannot monitor, verify, warrant or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because Boot Networks cannot monitor and censor the Internet, and will not attempt to do so, Boot Networks cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable or offensive Internet communications.
When subscribers disseminate information through the Internet, they also must keep in mind that Boot Networks does not review, edit, censor or take responsibility for any information its subscribers may create. This places on subscribers what will be, for most, an unfamiliar responsibility. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information they create is carried over Boot Networks facilities and may reach a large number of people, including both subscribers and nonsubscribers of Boot Networks, subscribers' postings to the Internet may affect other subscribers and may harm Boot Networks's goodwill, business reputation and operations. For these reasons, subscribers violate Boot Networks policy and the Services Agreement when they, their affiliates or subsidiaries engage in the following activities:
Spamming -- Unsolicited, commercial mass e-mailing (known as "spamming") is a strongly disfavored practice among Internet users and service providers. It is particularly harmful not only because of its negative impact on consumer attitudes toward Boot Networks, but also because it can overload Boot Networks's equipment and disrupt service to Boot Networks subscribers.
Copyright Violation -- Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer, and can involve the ISP in litigation and possible loss of reputation.
Distribution and/or Transmission of Obscene or Indecent Speech or Materials -- Violation of indecency and obscenity laws can result in criminal penalties.
Defamation -- Defamatory speech distributed over the Internet can result in civil liability for the defamer and litigation against the ISP whose facilities were used to distribute the defamatory material.
Illegal/Unauthorized Access to Other Computers or Networks -- The illegal or unauthorized accessing (often known as "hacking") of computers or networks carries potential civil and criminal penalties under both federal laws and the laws of most states.
Distribution of Internet Viruses, Worms, Trojan Horses and Other Destructive Activities -- Distribution of Internet viruses, worms, Trojan horses and other destructive activities, such as hacking, can result in serious civil and or criminal liability under federal and state law.
Export Control Violations -- The law limits the ability of persons to export encryption software, over the Internet or otherwise, to points outside the United States.
Other Activities, whether lawful or unlawful, that Boot Networks determines to be harmful to its subscribers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the service or the Internet.
As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the subscriber. Boot Networks will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Boot Networks policy or applicable law. When Boot Networks becomes aware of harmful communications, however, it may take any of a variety of actions. Boot Networks may remove information that violates its policies, implement screening software designed to block offending transmissions, or take any other action it deems appropriate, including termination of a subscriber's contract with Boot Networks.
Boot Networks also is aware that many of its subscribers are, themselves, providers of Internet services, and that information reaching Boot Networks's facilities from those subscribers may have been originated by customers of those subscribers or other third parties. Boot Networks does not require its subscribers who offer Internet services to monitor or censor transmissions created by customers of its subscribers. At the same time, subscribers who knowingly transmit materials that violate law or Boot Networks policy are, themselves, in violation of Boot Networks policy. Similarly, Boot Networks anticipates that subscribers who offer Internet services will cooperate with Boot Networks in any corrective action that Boot Networks deems necessary, in order to correct and prevent the transmission of material that is harmful to Boot Networks or its subscribers. Failure to cooperate with such corrective and preventive measures is a violation of Boot Networks policy.
Boot Networks also is concerned with the privacy of on-line communications. In general, the Internet is neither more nor less secure than other common communications media, including mail, facsimile and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Boot Networks urges its subscribers to assume that all of their on-line communications are insecure.
Boot Networks can not take any responsibility for the security of communications transmitted over Boot Networks's facilities. Boot Networks will comply fully, however, with all applicable laws concerning the privacy of its subscribers' on-line communications. In particular, Boot Networks will not intentionally monitor or disclose any private electronic mail messages sent or received by its subscribers unless required to do so by law. Boot Networks may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Boot Networks may be required to disclose information transmitted through its facilities in order to comply with court orders, statutes, regulations or governmental requests. Finally, Boot Networks may disclose information transmitted over its facilities where necessary to protect Boot Networks and its subscribers from harm, or where such disclosure is necessary to the proper operation of the system.
Boot Networks expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of on-line communications. A subscriber's failure to comply with those laws will violate Boot Networks policy. Finally, Boot Networks wishes to emphasize that in signing the Services Agreement, subscribers indemnify Boot Networks for any violation of the subscriber of the Services Agreement, or of law or Boot Networks policy, that results in loss to Boot Networks or the bringing of any claim against Boot Networks. This means that if Boot Networks is sued because of activities of the subscriber that violate any law, the Services Agreement or this policy (which is part of the Services Agreement), the subscriber will pay any damages awarded against Boot Networks, plus costs and reasonable attorneys' fees.
We hope this Policy Statement is helpful in clarifying the obligations of Internet users, including Boot Networks and its subscribers, as responsible members of the Internet.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
